Sorry for the belated clarification. Observer 53 evaluated my situation correctly. My current state court gig opened in 2014, well after I had started (for the second time) the ALJ process in March 2013 and had taken the exam in September. In the past, I have also applied for other judgeships when on the ALJ register. As a reminder, I have been on the register since 2009. My message is simple -- pursue all of your options.

sorry for the delay in responding. I left home yesterday to travel to an out-of-town docket and have been in hearings today. Waiting for the last claimant to appear, or not.

As I read the info I found, if I'm subject to Social Security and Medicare tax withholding on my state earnings, which I am, the offset doesn't apply, as the work is "covered by Social Security". I'm paying in for both SS and a state pension. Right, or wrong?

Minny it doesn't have to be on your GAL for this present Register, except the only opening for the position is in Arlington, VA. Hence, you would have to move there to accept the position if it is offered to you. It is a position that will be hired not from the newly created OPM Register, but from the all applications submitted from those interested in the position. However, based upon your response, I am assuming you do not wish to work in Arlington, VA. I just wanted to make it clear they will not be hiring from the new Register.

My intended observation was that the 7 year experience requirement and general competencies seemed very similar, making me wonder why DOI wouldn't just accept an application from someone like Minnie who had already proven herself by making the ALJ register. They don't hire off the register because the AJ is a different job classification than the ALJ one. Why they use the AJ instead of the ALJ position in their offices, who knows. I suspect someone who meets the ALJ requirements would also meet the AJ ones, but an AJ position requires a separate application.

The issue regarding AJ vs. ALJ is really judicial independence. From the Agency perspective its the ability to "control" the AJ and if neccesary fire and/or discipline him/her. Which of course takes us back to the APA.
When you come from an atty position and look at the AJ position vs the ALJ position you may think they are very much the same. Once you get on the inside you realize how important the APA is and that the protections afforded to ALJs are worth fighting for.

I worked with someone who worked for many years as a public defender in Maui. After morning docket, the attorneys would often make a stop at the beach to catch the surf. Then go back and work a little before cracking open some cans of beer (or whatever their drink of choice might have been) to prepare to do it again the following day. That environment is not quite what I have at my job, but I am extremely happy with where I work now. When I started this process last March, I wasn't quite so thrilled with my employer (but loved my line of work). While in the process of this, I kept an eye out for improving my own work life and landed a job that I had tried for a couple times before. I assume that most others know that the ALJ job is not the only gig. And I'd include everyone from applicants to current ALJs. By all accounts, being an ALJ is not such a shabby career, but, contrary to how involved all of us become in chasing that job, it's not the only rewarding legal job. I always keep my options open and suspect everyone around here does too.

Back in a previous career I practiced immigration law where I had to work with immigration judges. I believe they are AJs. I never noticed any sort of control that any federal agency had over decisions that immigration judges made, nor did I ever hear any complaints by them. They controlled their courtrooms like it was a federal district court and seemed to have that level of power. I don't think any of them would switch to being an SSA ALJ just to get APA protections. But I am just making assumptions that might be wrong.

Unless the Union is able to change the current situation at ODAR we are losing almost all APA protection due to the new position description and management's micromanagement attitude. Fortunately if we don't ratify the new Contract, I think we will fall back under the old Contract which may really be the best solution.
