I understand that I must have my paperwork submitted to ODAR by November 10,2014 close of business. What is the "close of business"?? Also, how soon should I expect my references to be contacted after November 10, 2014? Does ODAR interview first and then contact references? I am really interested to know when my managing attorney may be contacted. Close of business means end of the work day, end of business hours.

Once in the past, though, I misjudged the time difference and sent it after that point. When I realized that, I sent a frantic email and was told I was OK with my filing.

All of my references were called well after the interview last time. Think it's just luck of the draw or where your name falls on the contractor's list.

I can't get to my old PM's right now, when I can I can relive what happened thru my PMs with a board member.

Of course responsible people are going to return their paperwork in a timely fashion, but as the email says, if not received, Bob et al will call, so no need for panic...

I learned a valuable lesson on deadlines many years ago. As a government attorney, I was representing a county in an employment discrimination, whistle-blower, and ADA violations lawsuit. I was able to get the case tossed on summary judgment because the plaintiff had not filed with the state civil rights commission within the period provided by statute. Plaintiff claimed he did file in a timely manner as he faxed it in on the last day of the deadline (Friday). He even had so-called proof. The header info on the fax transmission. I pointed out to the court that the owner of the fax machine programs the date and time into the fax machine; I could produce a fax transmission showing it had been sent in 2046. The fax header really didn't prove anything.
I argued the deadline was not met since the commission marked the document received on the following Monday. Hence, he was a few days late. I also pointed out that plaintiff's fax copy, if it were believable, shows it was sent hours after the close of business that Friday. So, can someone claim they satisfied the statute of limitations by slipping the Complaint under the courthouse door after the court had closed for the day? Of course, not. The judge agreed and granted our summary judgment motion.
Because we had wasted so much time on this case and subpoenaed voluminous records, I decided to file a motion for sanctions and costs. Up the that point, the courts considered it the cost of doing business for the county and, if anything, might award $100 for a discovery violation. Forget sanctions. However, when I showed the court all of the impeachment material I had and how the plaintiff made numerous contrary and conflicting statements, the judge granted our sanctions motion for filing a frivolous lawsuit. We got nearly $120,000.00. Both the summ judgment and sanctions were affirmed on appeal.
Don't think deadlines are crucial? Ask Mr. Plaintiff what he thinks about deadlines now.

As a cautionary tale, when I emailed my first batch of docs, my email bounced back as the file sizes were too large. Why wait to the last minute in the event you have a problem or your scanner doesn't work, etc? Although now I'm stressing about my city rankings, it feels great to know my paperwork is in with Bob.

Why wait to the last minute in the event you have a problem or your scanner doesn't work, etc? Although now I'm stressing about my city rankings, it feels great to know my paperwork is in with Bob. I sent mine in two batches as I anticipated there might be an issue with file size. I think there was something in the initial email indicating we might have to submit in two separate emails.

My initial .pdf file was 20.6 MB. I saved it as a reduced .pdf and got it down to 4.1 MB. No problems sending, in a single file. Done!

I'm with you myfingercrossed, in that I don't say much and sent in y paperwork an hour ago. This time, I do have something to share and that is that the error of sending the two questionnaires and not sending the consent saved me. I got the second e-mail and never got/saw the first, despite checking spam daily since March 2013. I followed up with Mr. Bob and got back on track, just a couple days behind. Had snafu never occurred, I would have not known about the opportunity as it's been a while since I kept up with this board. No more of that!
