As interesting as the Binder bankruptcy analysis is the news Carolyn Colvin won't be confirmed as Commissioner of Social Security. Interesting times indeed.

Thank you so much for posting this news. I had no idea. Here, I've been resenting Binder as a competitor stealing all of the good cases from my "boutique" practice! Nice to know I'm not alone in battling to survive as a claimant's rep in late 2014. I'm currently taking over a significant portion of another discouraged attorney's caseload. He wants out. I've also been propositioned by yet another retiring attorney to take over his caseload but I can only handle so much at a shared fee rate. SSDI practitioners are jumping ship by the day. It's a harsh economic reality.
As an aside, I filled out my ALJ application in March 2013 and that very day, I received my 2012 tax returns from my CPA. I made more money in private practice than a top paying ALJ. I thought, why give up a good gig? So I did not press the SUBMIT button for that register. Big mistake.
The glory days of private practice attorneys hauling in the cash are over. Now, it is all that I can do to work harder than ever and simply pay overhead with a little left to spare at month's end. I personally know of many private practice claimant's reps who have had to make big cuts to staff and advertising. It is commonly understood these days that you take a case for the long haul- i.e. in anticipation of an ALJ denial and in hopes of a windfall at Federal District level.
As I stated on another thread, an ALJ job is looking better by the day.

I wonder if the fact Acting Commissioner Colvin will not be confirmed as Commissioner will affect the total number of hires originally planned as she was the one pushing for the uptick in the hiring of ALJs? Interesting times indeed.

First, the U.S. Senate did not vote on my nomination to be Commissioner of Social Security, citing the parliamentary requirement that, as a cabinet level official, 30 hours of debate would be required at a time when they had only a few days left to confirm over 20 nominees. Colvin was not confirmed because of several criminal investigations in SSA. I'm a little confused at the moment -- was she actively rejected in a vote (i.e., not confirmed), because of these criminal investigations? Or, was the vote never held in the first place, because of parliamentary maneuvers owing the relative low priority of appointing a permanent SSA Commissioner? I was led to believe it was the latter -- given how many other higher-priority spots the Democratic Party would like to fill during the rest of this brief lame-duck session. |

I was led to believe it was the latter. I was also led to believe it was investigations - NOT criminal, mind you, but the Congressional variety.

OK, thanks, Gary, that's pretty much what I was getting at. I wonder if, given the politicized nature of SSA/Congressional relationships at this present time, and given these investigations, ANY prospective Commissioner would have an easy time getting confirmed. Like a case of blaming the messenger, and mistaking him or her for the culprit. |
