SEC ALJ hiring practices are probably flawed and are definitely under attack. If you find a WSJ article from Tuesday you will see a US Dist Judge openly questions the hiring of ALJs by anyone but the SEC Commissioners. Some folks agree and it seems the SEC Chief Judge essentially does the hiring and not the SEC bosses - the problem. Most agencies with full up adversarial type hearings reserve the hiring of the judges to the Board, Commission, etc. This is not good karma and is bad drama. Until they get this right, I might think twice about the SEC.
