While I can't speak for JH, I believe that I comprehend her inquiry and can shed some more light on it. The "two Certs" reference includes: (1) the November 2007 "first" certificate of eligibles, which was the basis of the emails sent by OPM and SSA, respectively, to ALJ candidates dated Friday, November 30, 2007; and (2) the April 2008 "second" certificate of eligibles, which was expanded in June 2008.
Those that were not selected off of the first certificate of eligibles received an email from SSA's Patricia Rocheford on Tuesday, April 8, 2008, stating: "We are sorry to advise that you were not selected for the Administrative Law Judge position with the Office of Disability Adjudication and Review."
That April 8, 2008 email went on to read: "We look forward to considering you at such time as your application is again forwarded to [SSA ODAR] from OPM." In actuality, irrespective of the email's last sentence quoted above, ODAR refused to consider more than three dozen individuals that had their names "again forwarded to SSA ODAR from OPM."
More than three dozen individuals on the first certificate were considered three times by ODAR and passed over three times. And more than three dozen such individuals that had been passed over three times in February 2008, had there names listed on the second certificate sent to ODAR by OPM.
Unbeknown to many is that none of these three dozen plus individuals were considered by ODAR for any ALJ position subsequent to April 8, 2008, notwithstanding the fact that their scores landed them on the second certificate of eligibles. Alternatively stated, if you were passed over three times on the first certificate of eligibles you were not considered for an ODAR ALJ position at anytime between April 2008 and July 2008, notwithstanding the fact that your name appeared on the second certificate of eligibles. See 5 CFR 332.405.
[As an aside, it is more likely than not that the reason that the April 2008, second certificate of eligibles was expanded in June 2008, is because ODAR refused to consider these three dozen plus individuals when their names appeared on the second certificate issued to SSA ODAR by OPM.]
More significantly, the import is that after having been passed over by ODAR three times, an October 30, 2007 NOR recipient should never expect to be considered by SSA ODAR for an ALJ position anytime before a new register is created in 2010 or 2011 and they make it onto the new register. Alternatively stated, if you were considered and passed over by ODAR three times in calendar year 2008, you should not expect to be considered by SSA ODAR for an ALJ position in 2009 irrespective of the fact that your name may be on a certificate of eligibles issued to ODAR by OPM sometime in year 2009.
While this may come as good news to those sitting for the Structured Interview (SI) and Written Demonstration (WD) for the very first time this year (2008) or early in 2009, it bodes poorly for those "newbies" that are passed over by ODAR three times in year 2009. See 5 CFR 332.405. Once considered and passed over by ODAR three times in year 2009, those "newbies" won't likely be considered by ODAR again unless a new register is created in 2010 or 2011 and they make it onto the new register.
If you were on both certificates of eligibles, your score was above 58, and you were in the running for more than four cities combined during the first two rounds of ALJ selections by ODAR, and you received two rejection/condolence communiques from ODAR, then you ought to immediately send a private message to JaggHagg.
