Major Duties:
The Offices of Administrative Law Judges is responsible for conducting rulemaking and adjudicatory hearings under the Office of the Secretary at the Department of Agriculture. All of these proceedings affect the nations food supply, the quality of the food supply, returns to the farmers, and the consuming public.
As an Administrative Law Judge (ALJ) the incumbent conducts proceedings in accordance with the Administrative Procedures Act (5 U.S.C. 556-7), and approximately 31 statues administered by agencies within the Department of Agriculture requiring APA hearings. These statutes include: the Agricultural Marketing Agreement Act, 1937 (7 U.S.C. 608c (3), (4), (15); the Packers and Stockyards Act (7 U.S.C. 193, 204, 213, 214; the Perishable Agricultural Commodities Act (7 U.S.C. 499 (h), 400d(d); The Animal Welfare Act (7 U.S.C. 2149); the Horse Protection Act (15 U.S.C. 1823c, 1825; the Federal Meat Inspection Act (21 U.S.C. 604, 606-608, 671; and the Animal/Plant Quarantine and related laws (7 U.S.C. 149, 150gg, 16, 164, 3904 (b), 3805; 21 U.S.C. 1041, 117, 122, 127, 134e, 135a).
ALJs preside at formal rulemaking hearings. They rule on the admissibility of evidence; set filing times, review hearing transcripts; and certify the record to the agency for decision.
In adjudicatory proceedings responsibilities include: ruling on preliminary motions; conducting prehearing conferences to settle issues or to stipulate facts; issuing subpoenas and prehearing orders; administering oaths; presiding at hearings which may include written and/or oral testimony cross-examination, and exhibits; questioning witnesses and determining credibility; and preparing and issuing decisions or approving settlement proposals with findings of fact and conclusions of law based upon the record and supported by reliable probative and substantial evidence. Decisions of a judge are reviewable by the Secretary's Judicial Officer. Unreviewed decisions become final, non-presidential orders of the Department of Agriculture.
Qualifications:
MANDATORY QUALIFICATIONS:
Candidates must hold an Administrative Law Judge position at the AL-3 level or higher, or must be eligible for reinstatement to an Administrative Law Judge position based upon prior experience as an ALJ.
DESIRABLE QUALIFICATIONS:
(1) Knowledge and experience in presiding at formal rulemaking and adjudicatory hearing.
(2) Broad legal knowledge and ability to develop quickly specialized knowledge required to deal with adversary proceedings brought before the Department of Agriculture.
(3) Ability to understand, analyze, describe and communicate difficult and complex technical, legal, and factual issues.
(4) Ability to render written decisions in clear and precise language.
(5) Ability to operate automated data processing equipment in composition and legal research environment.
You must be a U.S. citizen to qualify for this position.
You will need to successfully complete a background security investigation before you can be appointed into this position.
