What is "horse burger territory"? barkley and I can't disagree? What is a dissenting opinion? Why have them? Let's have just majority opinions! We are in agreement that personal attacks are out. OK, we slip up and make a few... But you'll notice that val and pf have armadillo skin. Given with what they're working with, they have to! I can see it if we were a bunch of tea sipping old ladies in a book club. But we're lawyers in a contentious, ego-bashing, withering application process (or recently having been through it) and we need to be who we are! This is an old complaint of mine. I think the moderators here have forgotten what true debate is all about. Sure, censor personal attacks, but let's not stifle debate.

I think "horse burger" territory is where self-absorption with seeing a black robe in the mirror, getting to hear one's self in front of a miserable captive audience of 12, telling the same old war story in a bar below street-level for the thousandth time, or buying that dramatic limited edition print titled, "The Cross Examination," starts to create a black-hole type entity that threatens to suck everything on the site into its depths to the extent that it becomes so dense as to bend light. Come Mr Poochkins! Time to find new moisturizer!

Horse burger territory is when, rather than have a rational discussion, one uses a comment as an opportunity to launch into the same old Agency bashing.
I certainly did not suggest that an attorney selected by SSA is any better, or any worse, than an attorney selected by any other agency. I think that some attorneys have a temperment that is better suited to some types of work than others. Can you really argue that the work done by SSA is less important than that of the dozens of other agencies that hire ALJs? It is not better or worse - it is just different and requires a different skill set.
To be clear, as attorneys, we should have a wide range of skills. People from many backgrounds adapt to SSA. But there are people each year who do not make the adjustment and leave the agency to pursue other options. Sometimes the really good litigators find themselves miserable in the non-adversarial environment and would be better suited elsewhere. Just as there are some very good attorneys who make excellent SSA ALJs would not be a good match for other agencies. Does not mean they are better or worse than anyone else - just funtion better in different environments.
It is just tiresome to constantly see the "us vs. them" "I'm better than you, obviously" attitude. Yawn.
