Hi all - been silent on here since I filed my appeal to not making it through the intial round back in May. I just received a secure email from OPM but when I looked at it, there is no message. It's simply a confirmation from the helpdesk that they received my email...ya know, the one I sent in MAY! Did anyone who filed an appeal get a similar message? Does this mean that they really hadn't even processed appeals until now?

No, this means that they have not gotten around to acknowledging the appeal until now. They will not begin processing the appeals until all the people who managed to jump through all the hoops of fire without getting burned are given their NOR. Then, the people who were thrown off in rounds two and three will get to file appeals. AND THEN....TA DA>>> they will look at the appeals. Presumably some people will be given an opportunity to go through the process and some people will be told again that they did not make the cut. I do not know if you can appeal a second time. But really, isn't this FUN!!! ?

I was aware that the first timers wouldn't get reviewed until after everyone had gone through the process. I completely didn't even take into consideration others that are going to appeal along the way. Sheesh, glad I am not holding my breath or I'd be dead by now.

Yeah, I look at this like the Publisher Clearing House contests. Back when I was a newly minted grownup with my own little house and spouse, I used to do the PCH contests regularly. I would scratch and sniff and paste and mail with great hopes of being that lucky man/woman standing at the door shaved and ready for a closeup receiving the SURPRISE batch of balloons and awesome check. One day I looked at the contest rules and timing and discovered that the contest that I was playing did not end until several years down the road during some as yet unannounced football game. That is sort of like this. You fill out your application, get all excited, follow all the rules, maybe file an appeal and the contest doesn't end until months, if not years from now. I have stopped playing PCH contests, but I apparently still hold out hope that someday I will be sitting by the phone and I will receive the coveted "you are a winner" phone call. Then I too can join the ranks of the "chosen" and complain about the job.

My view is that once you were denied advancement then in effect you have an appeal right vesting at that time. Thoughts?

Hello, everyone, I took a break from reading this board (for my emotional health) after the last hiring ended. Had gotten on the register in 2007 when it reopened after the long hiring freeze. On 2 certs. I was cut after phase 2 of the current exam. Like some of you, I have begun to view this process as lottery-like. That said, I do want to appeal because it makes absolutely no sense that I would not be even more "qualified" now. I searched this forum for some more information on how to appeal and couldn't find anything. Would deeply appreciate some guidance from anyone who knows how it is done.

As I understand it, everyone (including those cut at earlier stages) will get a formal NOR when all the scoring is completed, which will have appeal rights on it. You can file at that time whether or not you filed something earlier, I would think.

I didn't see it either until it was pointed out to me. And the Publisher's Clearing House analogy is apt. During the years and years of Azdell litigation, when the Application process was closed, those on the Register waited many years for a call (or not).

I'm pretty confident that a register will be put in place and certs drawn from it while the appeals process goes on. There have been appeals on all the registers and refreshes since 2007. They didn't stop the process.

I think OPM's email said that appeals wouldn't be processed until the application process was complete - I took this to mean that the appeals wouldn't be processed until people who finished testing received their NORs. If an Agency requests a cert. from OPM once this group receives their NORS, I think OPM would be obligated to provide that Agency a cert. from the registry of new scores, regardless of whether the appeals have been processed. If you decide to appeal, and there's cert. pulled, you're name probably wouldn't be forwarded.

All I can say, and others have more or less said this before, welcome to SSA's and OPM's version of russian roulette. The claimants that anyone who gets a call to be an SSA or Medicare ALJ will be happy to ask you why did this take so long. (Am just closing out a case that took 4 years. Client didn't have access to health care until right before the hearing so the DDS examining consultants who wanted x-rays and didn't get them couldn't render much of an opinion on a congenital health issue that did not become disabling until adulthood). And that does happen. Something that we can tolerate in our youth progresses and just slams us as we get older.
