If it means anything at all, our office is offering overtime both Saturday and Sunday this weekend. It is the end of the fiscal year and management does want those decisions.

NLRB has 40 ALJ's from what I understand. This may be more than 1 years worth of attrition. Some die, some retire, and some just get lost going to work. It seems strange to me that with all of the cut backs, SSA still has overtime pay and everyone is still hiring some ALJs.. As far as I know, SSA did not furlough anyone this year, I might be wrong, but never heard of any.. SSA and FMSHRC currently have money. Other Agencies that employ ALJs, not so much. NLRB is hiring to replace attrition, as you have alluded. It is a mistake to compare apples to oranges. In another month SSA could be broke--or flush. It all depends on a Congress that is unable to predict what it will do from minute to minute.

I am not an ALJ so I can't speak to job security for them. But according to one of my physician friends, there is no job security for them and the sequester has cut their travel budgets for professional travel. (This is for DoD employed physicians.). None of them are looking forward to a shut down.

Aljjustice, job security yes, fund security no. There have been instances of ALJs being subject to a RIF, but it is exceedingly rare and can be political. I think the real danger is the current Congress and their views on the Feds and ALJs...
