The salary structure for ALJ's is clearly set out elsewhere, including regional differences in pay. There is a provision (I don't recall just where) that states that the agency (or OPM?) may start an ALJ out at the second-year salary level rather than the first for an exceptional candidate or some such verbiage.
Q: Does anyone know any ALJ who actually was allowed to start out at the second tier salary for his/her position? What were the factors that went into the decision? When in the process is the time to make that request?

The times I have seen it is when the new hire is coming from within the Agency or another Agency at a commensurate pay level. I haven't personally seen it done for an outsider, but it may be possible. I don't know if you would bring that up at the time the job is offered to you or not. That is when they tell you what your salary will be. Others may know more.

The only situation I have seen for this type of increase is for civilian federal employees who were making more than the ALJ-3A salary when appointed. I know a couple ALJs who came from the military, and who made more, but they did not receive an upgrade. There were several ALJs in my class who were senior GS-15, and most were bumped a level so their pay would not decrease. However, at least one did see a decrease, because the base pay for ALJ 3A was higher than their GS base pay, even though when locality pay was included (this ALJ changed cities) there was a small difference. What I have not seen is a non federal employee receive a bump. I'm not saying it can't happen - certainly the rules allow it - but I haven't seen it in the wild.

I asked such when I became an SSA/ODAR ALJ. As I am a legend in my own mind, I thought my 10+ years as a trial judge in the military would at LEAST put me one or two steps ahead of my classmates. I think the Agency is still laughing/chuckling over my request. A "Possible" in the realm of possibilies out there ... but not probable. But what the heck, if you don't ask, they'll never be able to say no! And think of the posts YOU'LL be able to add!
