The Agency needs to be able to hire whomever it wants, within the law and the regs, and not hire someone who is not wanted, for whatever reason. This gives it some flexibility in the process. Pixie.

Sheath those claws, Roggenbier. There is no civility in any employment arena and merit is always in the eyes of the appointing officer, public or private. When candidates rant about the "fairness" of this system, my gut reaction is to wonder why you think this process is any different from any other employer hiring new employees.
Everyone who makes the final interview with an employer is qualified to do the job, whatever that job may be. But not everyone is the best candidate for that employer. If there is a "golden child" on the OPM register who is never been passed over for a job or promotion in his worklife, that person is truly unique. But I suspect the majority have an experience more like the story my husband told about his law school class.
The freshman class had over 600 students. They were told to look left and right. By the end of the first year, at least two of them would be gone and probably all three. Sure enough, only 150 graduated.
So you made the register. Look left and right. Only one of you may be selected and possibly none of you.

Well, how far back do you want to go? In the 1990's the agency tried to promote a program wherein the judges would mentor the staff attorneys. It was a conspiracy to replace the judges! Then the senior attorney program came along. It was a conspiracy to replace the judges! With HPI there was a wave of promotions to paralegal/writer jobs. It was a conspiracy to replace the attorney advisors! The conversion to computers came along. It was a conspiracy by Baltimore to spy on everyone! Electronic folders? Another conspiracy! The change in the testing for ALJ positions in 2007? An SSA conspiracy to favor insiders at ODAR. Every time that OPM opened the register under that ridiculous plan to stop receipts when a certain number of applications were received? More conspiracy because everyone knew the SSA folk were tipped off ahead of time to the disadvantage of the outsiders. The national writing and pulling centers! A conspiracy to destroy the hearing offices in the field. The latest work at home where your computer logs into the server and someone can tell if you are on-line or not? I smell a conspiracy! If there is any change in the system, I can assure you that someone "knows" there is a conspiracy to work toward the demise of one or more groups of employees.

Long day, Father in Law died. Wasn't paying much attention to punctuation. Note to ODAR: Disqualify this candidate for failure to adapt punctuation to stress.

What they did with me last time, was to keep me on about 9-10 cents without choosing me. They three struck me when they notified me that my name would not be sent to ODAR in the future.
They will find ways to dig deep in the register....come up with the people they want. Kinds of undermines the strict meaning of the regulations, but we live in a day of expandable meanings.

Dear Roggenbier: I understand your situation as well as anyone can. I lost my beloved spouse of 30+ years in March. You and your family will now be joining me on the journey to recovery. As you start, I beg you to make this a celebration of your father-in-law. Remember the good times your family had and share those funny stories. It is okay to laugh at the funeral home as you share with the rest of the family. And I can tell you this. If you do celebrate, that uplifting ceremony will be a great comfort to you all. Because my spouse's funeral was a positive event, people are not afraid to talk to me about him. To the contrary they want to tell me stories and tell how they still find inspiration in his life.
