My bet is that Corona Virus or no, video hearings will be here for a while. Attorneys don't have to travel, the administration can slot judges all over the place, administrators will love it. Myself, I like to be present, better eye contact even if you can't see the face. Handups to the bench are easier, too. But that's me.

Recently received an email from the HOCALJ requesting Standing orders for the OVR process. Standing order #1- All parties must wear pants Standing order #2- Unless relevant to the facts of the case, cameras should at no point be aimed up nostrils. Standing order #3- No one may record me; in the event this rule is going to be ignored, then I must be shot in flattering lighting and exclusively on my good side (TBD)

I had my first video hearing yesterday and it added nothing of value. The claimant was backlit from a window so hard to see well. Half the time I had the Teams window covered with another program anyway. What do other people think?

I think it a total farce to favor video over phone hearings. We will be doing it because it's "cooler," not because it adds anything. It is certainly more complex and likely to cause more delays and confusion than telephone.

It is certainly more complex and likely to cause more delays and confusion than telephone. I haven't done any video hearings through MS Teams yet. But I have done many video hearings in the past and I would have to say they were somewhat preferable to phone hearings, mostly because it can be easier to understand what someone is saying at times if you can see them. But I don't know if we would really see that benefit with MS Teams, and I am definitely anticipating some downside.

As for you covering up your screen with other programs, that seems more like a technology issue. I assume you have two monitors since the Agency will let you use two agency ones now? If you put the MS team on the laptop (third screen) you should not be missing out on anything/real estate.

Our IT couldn’t make it work without me losing the use of my mouse. For my mock hearing I just used a split screen on my laptop and my personal monitor for the 3-screen option.

I’ve had several OVHs now and it depends on where the parties are. The best ones were where the claimant and rep were in a conference room together. The worst by far was a claimant who was holding the phone/camera so close to his face all I could see was from the bridge of his nose to his eyebrows; then there was the case using the telephone interpreter who must have been in a mall or store as there was a ton of background noise, and the claimant couldn’t hear her - she had to keep bribing the phone to her ear, so I got a great view of either her ears or her eyebrows, and not much else, making the video totally useless.
I’ve done a ton of zoom meetings for non-work related activities, and I’ve rarely seen a similar level of problems.

Although, I try especially hard to not be catty when I am using it. Pixie
