Assuming you do not spend 100% of your time performing qualifying litigation or administrative law work, how do you respond to this question? I'm an attorney for a federal administrative agency, but spend about half my time conducting investigations prior to any formal procedure being initiated. Guesstimating the amount of time I spent on every qualifying legal matter would be nearly impossible - we're talking about going back 18 years.

When I put together my app last year, I did so with the assumption that OPM would not accept 100% as an answer. I used 75-80% and then calculated the time. For example, if I was in a job for one year and it was 75% admin law, then I counted it as 9 months. With 30+ years of legal experience, I had no problem coming up with the amount of experience OPM wanted.

I feel sick. I didn't read the question as requiring you to include percentages. My work experience is as a litigation attorney -- 100% of work time performing litigation tasks. I read the question to mean that percentages were required only where qualifying experience overlapped with other non-qualifying experience. So, if for example, you were performing estate planning for 50% of your practice you should indicate that 50% of your time was spent in non-qualifying tasks. Since all my experience was qualifying; I didn't type into the form a statement or other indication that I performed qualifying tasks 100% of the time.
