Does anyone have any tips or comments on securing an ALJ position with an agency other than SSA? In particular, is there any point in going to SSA as an ALJ for a year or two and then seeking a transfer to another agency? I have substantial experience litigating before ALJs of several administrative agencies -- other than SSA -- and ideally I'd like to wind up as an ALJ at one of those agencies. I am only an applicant (8/1/08) to take the ALJ exam and understand I would need to pass all three parts of that exam before my questions would be relevant, but I don't want to wait until an offer arises before starting to think about this. It is easier for other agencies to "poach" qualified candidates from SSA than to request a roster. Usually, other agencies hire one or two folks at a time, which makes the OPM roster requirement a crapshoot. By relying on recent SSA hires, the other agency can hire purely from the standpoint of resume and experience. I was appointed by SSA, but shopped my resume around and after a year transferred to DOL OALJ. Other folks have done the same.

The advice I was given was the same as civilserpent's experience. Although in the last round, there were a few agencies that pulled certificates (OMHA, HUD and DOL), I don't believe any except OMHA actually hired anyone off the certificate. My understanding was that it was unusual for DOL to take a certificate off the register. The usual deal is for agencies to advertise for "experienced" ALJsk and grab folks out of SSA

Are agencies required to advertise ALJ openings on USAJOBS or are some of the positions filled through some other means? Is there a preferred time to hop to another agency (i.e. a number of years of SSA experience that is ideal)? Any other insights into the process? Thank you!

Well, I believe SSA expects a 2 year commitment (and if you've taken the relocation package, you need to fulfill that 2 yr commitment or pay back the $$$, as I understand it). I don't know about "required" to post jobs on USAJOBS, but I know that agencies DO post on USAJOBS. Be that as it may, I do know of at least 1 ALJ who agency hopped after only 1 year. I don't know if the position had been posted at the time.

I know a couple of judges who transferred to other agencies after less than a year with SSA. SSA had to give them permission and, significantly, neither had moved at SSA expense. I think that lurker is probably right. If SSA has paid to move you they will insist on a certain minimum period of service.

The CFR has a waivable requirement for one year of service before transferring. 5 CFR 930.204 Appointments and conditions of employment. (h) Transfer. An agency may not transfer an individual from one administrative law judge position to another administrative law judge position within 1 year after the individual's last appointment, unless the gaining and losing agencies agree to the transfer.
