It is well past time that we close the evidentiary record. Kudos for the proposed rule. IF, and I repeat, IF the AC actually develops a spine. Looking at dismissals and what happens to them if appealed, I have real doubts. I fear good cause will be interpreted to equal the rep or claimant wanting to introduce evidence after the deadline. Only time will tell. |

The best news is that regardless of the spine the AC, oops! Review Board does or does not grow, the appeal will cover only the period prior to the ALJ decision, thus the end of the perpetually open application. Yay!
