Congratulations to all who advanced, and my deepest condolences to those who have experienced what will only be a temporary delay. The details are certainly different this time around, yet the results continue to have the same old feel for better or worse.
For the lucky people who have advanced, allow yourselves some reasonable celebration, but please don't forget that you are still less than half way to the prize. Your final OPM score will be determined by the structured interview and the written examination. If the score is low enough, you will make it on the register, but you may not ever make it on to an agency certificate. Then, even if you should make it on an agency certification, you can lose out to more qualified candidates, blow your interview, have one of the interviewers blow the interview, get blackballed by someone in the hiring agency, or your own agency, etcetera, etcetera. One would assume that all of the brilliant legal minds on this Board would have an easy time maintaining their objectivity and not allow themselves to make an additional reckless emotional investment after advancing further in such an infernal process...
For those of you who have NOT advanced, you are in grand company with multiple ALJs and even Chief ALJs who did not even make it this far their own first time around. Mistakes are made and some appeals come true! If you are confused, angry, or feel unlucky, you are most likely a very decent and sane individual. On the other hand, if you allow a government agency like OPM, having a truly breathtaking reputation for well-intentioned stupidity and incompetence, to define your value as an attorney or a person, its probably best you did't advance...

I realize that I have to continue to excel in order to achieve my ultimate goal.

8-)Back when I applied in the dark ages to get on the ALJ register, it was something that got around by word of mouth. And as I have said before, you were placed on a general register for all agencies and your position on the register was governed by your score, and played a large part in your selection. The agencies would request a register of the top 10, or depending on their needs. SSA//BHA/OHA of course needed the most. I got selected, and appointed. No big deal, had reservations, as I wanted to continue in law. Friends in the profession said I should take it, and I did. If I had to put up with what y'all are doing, don't know.

Last night Mrs. Gaidin and I had this conversation:
G - I feel guilty because I don't want to exercise self restraint. Mrs.G - What? How? (Eyebrow raised) G - I think I want Popeyes for dinner. Mrs.G - Oh well sure fine then. I thought you were going say we should buy that truck. G - Oh heck no. After I get that job though I am buying a monster truck.

As soon as I received the email for the WD, LBRT, and SI, any and all reality checks for me bounced.

For those of us who are true Board veterans, then you know val has personal experience regarding these issues. That she is now a happy ALJ speaks to her grit and perservearance. I have no doubt but that she is one heckuva Judge. Having said that she can be a real pain in the kiester.

I have to say, like others with an EA of 5 and decades of judicial/litigation experience, I'm disappointed and frustrated. Now I'm also a little bit hopeful. Maybe the appeal will go nowhere, but I encourage all who received the Dear John e-mail to appeal! Obstacles put in your way are to see if what you want is worth fighting for. And who knows, your appeal may result in a score higher than someone who made it to the third round without this fight. I have no intention of leaving the board or leaving the queue that easily. <Cue Braveheart theme song> This, as someone on the board said, is a marathon, not a sprint. If you know you have the character and judgment to make a fantastic judge, you owe it to the SSA, nay, the citizens of this great country to continue the fight. Don't go quietly into that good night...I won't. We're not finished by a long shot. To all of those moving on, a big congratulations and a bravo! But we are not far behind you, and we will see you at the finish line.
