I know a few people have received offers, but I am surprised that there have not been more. I wonder if the lack of offers has to do with EOIR waiting to get a FY2024 budget (rather than the continuing resolution that they have been working under since October). That could also just be me holding out hope that offers could still come. Offers from the October or December posting?

I have only heard of the offers listed in this forum for the October posting, but I kind of look at the October and December posting as one announcement. Maybe EOIR is not looking at it that way, but it kind of seemed that way to me.

Interesting case with the immigration judges. If the union is decertified, then as employees of DOJ, judges (even if they are union officials), are required to obtain supervisor approval and pre-clearance of any public statements. I don't think that would bar their honest and unscripted testimony to Congress. The IJs have always been a little different from ALJs.
The irony here is that DOJ's gag order will probably increase the likelihood of negative Congressional testimony, rather than actually stifle discussion.

What happens to the role of the IJ is the Supreme Court turns agency deference on its head? More reason to turn IJs into article 1 (or even article 3) judges? The DOJ gag order seems like something Congress could use as evidence of the necessity to change the status of the IJ.

The DOJ gag order seems like something Congress could use as evidence of the necessity to change the status of the IJ. Chevron only applies to agency interpretations of statutes and issuance of regs in its delegated jurisdiction. That could apply to IJ or ALJ regulatory or statutory interpretation, but I have never seen Chevron used by any district or appeals court related to SSA ALJ cases. In fact, some small deference once in a while might be nice. I don't think revisiting Chevron will give Congress an incentive to change IJ status. If they became Article III judges, then DOJ would have no authority over them at all. I can't see Congress establishing a new cohort of specialized lifetime immigration judges.

The party out of Executive power tends to like the idea of making Immigration Court an Article I court. The problem is that it won't happen without a willing Executive, and we'll never have that because no Administration wants to diminish its own power.

Eoir got less money under budget bill just passed and signed into law than last year. The appropriations language did include this sentence that I though might help with hiring. "That not to exceed $50,000,000 of the total amount made available under this heading shall remain available until September 30, 2028, for build-out and modifications of courtroom space." Maybe we will start to see more offers if and when this passes the senate and is signed.

I applied to the October 2023 listing, interviewed in November, references checked early December, and received tentative offer end of December. Awaiting final offer. Was told class is expected to onboard in April but could be delayed.

I applied in the December posting. Had two interviews. I feel like they both went well. My references still have not been checked after the second interview. However, I know applicants from the October posting that had their references checked immediately after the second interview.
I heard from a friend who is an IJ that they put everything on hold until the budget was settled. So I’m not sure if I am out of the mix or if maybe they just paused the hiring process for all applicants. It seems like things are now moving again. Anyone else have a similar experience? Anyone from December posting have references checked?

Congratulations! I have heard of October applicants receiving offers but I haven't heard from anyone who received an offer from the December listing. Looks like you got an offer before the December interviews were conducted. Wonder why they added a December listing when they were getting good applicants in October. idk. Also, what jurisdiction and how did they notify of an offer (email, call, letter)? thanks for answering.

I had my references checked BEFORE my second interview, which upset me a little, because my employer was made aware that I was job hunting. Although supportive, I generally want to be tight lipped until I actually have an offer. Now my boss is so nervous that I am leaving that she occasionally asks me "what happened with that job?" which is awk-ward. Meanwhile, I haven't heard back.
