This public defender has the very unthankful job of defending a client whose defense, if any, will most certainly not succeed. But then, of course, he will be able to file his Attorney Fee Declaration for countless hours of work which, even at appointed counsel rates, should yield him/her a pretty hefty return at the expesnse of the law-abiding taxpayers. (It still truly amazes me the ALJ got off so, so lightly. The conspiracy charge alone should have netted him at least 20 years). Alas, politics. First, if Conn gets a Federal Public Defender, then there are still countless hours and no "hefty return." His lawyer will be on salary. If he gets an appointed defender, he'll earn likely every billed dollar on this complex case, which will undoubtedly be appealed.
Also, as a former FPD, I can state that I had many, many "unthankful" jobs, and some unthankful clients, but many who were very appreciative, even if the cases didn't turn out the way they wanted. If I were still doing that work, I would be eager to represent Mr. Conn. It would be a fascinating case.
One of my favorites was an escape from federal custody case (even though we lost the jury trial). If the Sheriff makes you leave the county jail at 2 am and puts you out on the street and the federal prison phone you are supposed to call only gives you a recording saying call back during business hours, is it "escape?" My jury said yes. Oh well. We tried.

I just read that Judge Daugherty is 81 or 82. At that age, sentencing him to more than 4 years wouldn't be of any benefit to anyone, as I see it. It won't deter him from doing it again. It won't rehabilitate him. Having him in jail at that age could be very expensive from a healthcare standpoint. jagvet, that had to be frustrating to lose that escape case.

I’m watching it too-way more ingesting than the American Greed episode. I mean you just can’t make some of this stuff up. What’s up with Judge Daughtery’s hair? Did he use curlers? Conn was married 17 times? The commercials are funny and nice to see the “Obama”’girl again. Unfortunately, it makes the SSA looks worse than incompetent. Conn is the gift that keeps on giving to TPTB.

I’m intrigued. I have an 8-hour flight ahead of me and guess what I’ll be doing. As a SSD rep, it has been inspiring over the years watching other reps and organizations like NOSSCR and NADR make sure all of Conn’s clients were provided fair representation. Was his name a self-fulfilling prophecy- Conn, I think so.

Was his name a self-fulfilling prophecy- Conn, I think so. Apple has a podcast too, but hope you will get to watch instead as more entertaining. I was impressed too with how the rep bar pitched in and congrats on the fee ceiling increase. I know it’s not enough but at least it’s a start. Counsel, you should also know that successful ALJs (to use management parlance) more than appreciates zealous and well prepared reps so keep up the hard work for your clients.

I'm downloading it so I can watch and get the full effect. The fee increase is much appreciated and good news; I agree, it's a start. I'm not one to complain about extra money! Thank you, Judge - I'm working on a brief today and enjoy collaborating with ALJs to ensure a full and fair adjudication process.
