I once represented a company in a disability discrimination lawsuit in which a guy with no arms interviewed to work in the companies "laydown yard" for a job that involved moving and stacking sheet metal and steel beams. Of course, he came to the interview and wasn't hired because the interviewing official saw he had no arms and said "he can't do the job". Well apparently, this guy has prosthetics that he could attach and do the work but he didn't bring them to the interview. I initially thought he was just setting up the company but he settled the lawsuit for just a job, no money. Then it turned out that this dude was a machine, apparently outworking everybody in the place.

More news from Judge Camp -
It will surprise no one that Gaidin is busy organizing things. This week it's an all-ALJ potluck dinner, in which we are encouraged to show off our cooking talents using only 3 knives, a cutting board, 3 pots, a colander, a cooktop and a microwave.
Actually thinking about it, it sounds more like an Iron Chef challenge. Results TBA!

Gaidin's cat herding ability suggests he's a future HOCALJ.

The river cruise was delightful and was far less boozey than Afed implies. We had cake at dinner and then went down the river while discussing whether we thought boat captain was sedentary or light work.
Some of my classmates have fantastic stories about their lives pre-hire and I am glad I got the opportunity to share with them. We are planning an outing to the National Archives and a potluck dinner.
I have to go compose a poem to dismissals. Good evening all.

Based on a recent trip along the Amalfi Coast (yes everyone should do it -- after the children finish college and before grandchildren), a boat captain is sedentary work as performed but heavy as described by most of them.

True story: a now-retired highly placed SSA official once contacted me from an executive-level meeting with a request to create some SSA-related haiku on the fly. I can't believe I forgot to tell that tale in my Skyline Tower interview. Amazing I still got hired. Anyway, taking up Gaidin's task...
On Dismissals
why you not show up? you and your rep were noticed hope you have good cause!
On Res Judicator
res judicata same facts, parties, and issues you are stuck with it
And getting a head start on Wednesday's lessons,
On DA&A
when does addiction create a prohibition? when material

Gaidin quit that darn training and tomfoolery and get busy making decisions. It is hard to believe you guys are still training. We had our three weeks of training and are now into our third week of decision-making at OMHA. Too much training and wasting of time on outings at ODAR and not enough time on getting out decisions. Just kidding you on your adventures, but not about our third week of holding hearing and making decisions here.

Glad to hear you're already a pro and hearing cases!

I suspect I will catch up in sheer numbers by the end of the year though.

I will be doing a thousand cases a year or probably about 400 or so by the end of the year. I doubt you will be near that amount. However, I am glad you are having fun. Sorry I missed out on some of it, but I am glad to be at my agency.

I have had a bunch of Medicare cases, including quite a few of the "big box" cases. Easier to get big numbers with the Medicare hearings, but it is all relevant. Do they still have the big box cases? Those could get into big money in a hurry. Pixie

Pixie Yes, big box cases still exist, along with statistical sampling, Parts A through Part D cases, Beneficiary cases, secondary payer cases, etc. Yes, it is all relative Pixie in terms of cases heard. The position at OMHA is more complex in the various types of cases heard in many ways compared to SSA/ODAR, but the workload and intensity of the job is equal in both ALJ positions. All ALJs deal with some unique issues related to their agency, but all ALJ positions have their perks and disadvantages. However, in my opinion, the perks outweigh the disadvantages by a wide margin.
