With respect to reconsideration of a Board decision at BVA, the Chairman can order reconsideration, but not order a specific result upon a grant of a motion for recon. The recon decision goes to a panel of Board Members (VLJs) who then have the same decisional independence as in any other Board decision. This is my understanding as well.

That situation seems analogous to the Arthrex decision and would be a violation. I think the Chairman has to be able to review the decisions of the VLJs.

Decisions of the Board are subject to review by the Court of Appeals for Veterans Claims -- an Article I court. Therefore, there is no Arthrex problem because there is another element of the Executive Branch that can overrule the Board's decision.

The last round of hiring included a good number of people with limited or no veterans law experience.

How much do they value veterans law experience or does an outsider have a snowflake's chance? Posters have reported that the last round of hires had folks with limited or no VA law experience. That's a big change from past practices. I was a staff attorney there, but left in January 2018. It would seem my infö on the organization and its practices is now pretty dated. Kinda like any advice some of us on here might have on the OPM testing process for ALJ... It looks like it's a whole new world at BVA. The "location negotiable" is a big change, too. I imagine it's a post-CoViD thing. You used to have to work in DC. Apply. Worst they can say is no...which they've said to me like four or five times

Good morning - you're welcome to tell the person on the VLJ thread, if you'd like, that approximately 35 judges are being sought and the duty location can be anywhere in the continental U.S. Lack of experience in veterans benefits law is not a per se disqualifier."

From a board member: Good morning, Pixie-- Can you please post anonymously that the VA hired multiple Veterans Law Judges who are not VA insiders. Also, many of the Judges will be working remotely across the country without any waiting period in DC. Thank you. PS--I was hired and have no background in this area of the law though I do have judicial experience. Thank you! Thanks so much for this info and congrats to the new VA judge! I gave this a shot and am wondering if this person (or any other board member) knows any details about the hiring process? For example, how many people applied, when interviews are being scheduled, when hiring decisions will be made, and most importantly, if any board members received an offer. (Fingers crossed). I love this new opportunity to apply for an ALJ position, but I don’t miss the stress of continuously checking emails and answering every phone call. If anyone gets an email, phone call, or has a timeline for interviews, I’d appreciate any info so I will know whether I still have a chance. Also, thanks to the board members who posted about this! I would not have known about it otherwise.
