As you may recall, I mentioned a friend of a friend that had no real lit experience but claimed level 5 that was reported to be in AR stat. Just heard he got cut. Dont know if he represents the one AR stat person cut or if he was not actually in AR. I'd vote the latter. Or maybe he and the poster true swapped statuses earlier this week.

I'm in the minority, but I still don't believe that this testing is as dependent on litigation experience. If it was, I wouldn't be getting through to phase three with eight years of experience. I think the SJT and writing sample were much more heavily weighted than they're generally being given credit for here. JMHO. I agree, despite having litigation in my background. The SJT was a defining factor more than anything else in Phase 2 of the process. I think a lot of people do not perform well under pressure on having to pick correct choices. I agree moopigsdad. I think the SJT was weighed heavily and probably a defining factor, at least in my case. I didn't expect to get through to phase 3 because of technical difficulties with my computer and I only had about 12 minutes to complete the essay. As I made it through I can only believe that I did well enough on the SJT to move forward. I rated myself as a 3 on the experience assessment.

He would have been found out as a fraud at the SI or at the Agency Interview if he somehow managed to con his way onto the register. Nearly 30 years of civil litigation, preceded by 6 years as a Claims Rep for SSA. Missed the cut in 2009, but I am moving on this time. See you all in D.C.

I take the "focus on litgation" with a grain of salt. I know recent ALJ's (last five years) who never set foot in a courtroom let alone acutally litigate. In my opinion, it's a bunch of malarchy! I'm in the minority, but I still don't believe that this testing is as dependent on litigation experience. hmm I disagree. From the people I know who didn't make the cut, having less litigation experience, and being an insider seemed to be common factors

I found my email in the SPAM folder. My status has been AR throughout. I have been practicing 8 years as a litigation attorney at a big firm; not an SSA insider. Here is what my email said:
Dear XXXXXXXXXX:
Congratulations! You have met the criteria to proceed to the next phase of assessments in the Administrative Law Judge (ALJ) examination process, which includes the 1) Written Demonstration and Logic-Based Measurement Test, and the 2) Structured Interview. These assessments are described below.
1. Written Demonstration (WD) and Logic-Based Measurement Test (LBMT). The purpose of the WD is to evaluate your ability to prepare a clear, concise, and well-reasoned legal decision of the type that one may be expected to write if employed as an ALJ. The WD is scheduled for 5 hours to allow time for instructions and other administrative processes, but actual testing time is 4 hours. The WD is conducted in a proctored environment using a laptop computer, mouse, and keyboard provided by OPM.
The LBMT presents applicants with a set of scenarios and multiple-choice response options. Only one response option in each scenario is logically accurate, while the remaining options are logically inaccurate. Applicants are asked to indicate which one response option is logically accurate. The LBMT is conducted in a proctored environment and is scheduled for 2 ½ hours to allow time for instructions and other administrative processes, but actual testing time is approximately 2 hours.
The WD and LBMT will be administered on the same day at a location in the Washington, DC area. A break will be provided between these two sessions. Plan to arrive at least 30 minutes early to allow time to clear building security. In addition, please allow time after the tests are concluded to complete certain administrative requirements.
2. Structured Interview (SI). The objective of the SI is to evaluate your responses to competency-based questions related to being an ALJ. A panel will conduct the interview and evaluate your responses. The interview will last approximately 1 hour and will be administered in one location in the Washington, DC area. Plan to arrive at least 30 minutes early to allow time for instructions and other administrative processes.
You will receive separate scheduling notices informing you of the date, time, and location of the WD/LBMT, and the SI, as well as other instructions about the process. The WD/LBMT will be conducted on a separate day from and prior to the SI.
Upon receipt of your scheduling/admission notices, rescheduling requests must be sent to the ALJ email address at aljapplication@opm.gov, as soon as possible. You are allowed to reschedule the WD/LBMT only one time. Because you must complete the WD and LBMT before you are allowed to participate in the SI, however, your SI date also will change. If you wish to reschedule the SI only, you may make that request only one time. Due to the specific timeframes associated with the ALJ examination process, OPM may not be able to accommodate all WD/LBMT, or SI rescheduling requests during this current assessment period. If we are unable to reschedule you for the WD/LBMT and/or the SI during this current assessment period, you will be rescheduled to a later date.
Attendance at these assessments in the Washington, DC area will be at your own expense.
Applicants who complete and meet the criteria for all three assessments will be notified of their final ratings when all applicants have completed these assessments. If you do not receive the required minimum score on the WD or SI, you will not receive a final numerical rating and will not be placed on the ALJ register. Applicants who receive final numerical ratings will be added to the new ALJ register, which will be used as a source to refer candidate names to agencies for employment consideration.

I wouldn't wish being cut on anyone, but by solace I mean that if those stats were as bad as they sounded, and he went forward, it would just be salt in the rejection wound!! Thanks for the follow up funky, this story had been really bugging me when you posted it awhle back on another thread. Again I don't want to appear happy for another's misfortune, but it would be so unfair to those who appeared to be more qualified than our 'friend' but got cut today. I hope we test on the same day, as OPM HQ is my old stomping ground (GWU grad) and there a more than a few watering holes we can tip a glass of our favorite I Am Not The Driver drink!!

Got my invite today as well. For those keeping score, I have two years private litigation experience, coming on six years ODAR experience, three and half of which is adjudication. Ten point veteran. Out of an abundance of caution I rated myself a two on the EA section. I probably qualified for three but I my old firm was unable to locate any of my notices of appearance in their files so I did not claim higher.

I am comfortable where I am, but still looking for greener pastures. This was one of the few jobs I was willing to leave my current position for. Que Sera Sera. On my way to local gin mill for some drinks and raw oysters with my wife of 26 years--how she puts up with my ALJ obsession and anxiety is beyond me---she deserves a date for putting up with me and moving more than 14 times in the last 13 years!
