I just received this from a board member:
Hey Pixie - I do not want to post this under my name but we just had a meeting that confirmed the info we had gotten from the AALJ.
ALJs and staff (except for AAs) are excepted from the furlough and are to report for work on Monday. Telework is not affected by the furlough; if you are slated to telework on Monday, do so. Leave is cancelled, but if you have planned leave you can agree to be on furlough for the period of the requested leave (which can be a day or an hour); see below. If you agree to be on furlough, you run the risk of not being paid once the shutdown is lifted; it will be up to Congress at that point to determine if furloughed employees will be paid.
It is basically what I understand.

keep in mind we, as in all board members, work for different agencies. so many of us at oho are working Monday but that is not necessarily the case for our colleagues who work for other agencies. Agreed. It's far too late for me to check now and my telework day is on Monday. Hmm. Do I report to work on Monday and say farewell to my co-workers, or do I telework on Monday and shutdown from there. I'm really not sure what the protocol is.

My understanding is that it is business as usual. If you are scheduled to telework on Monday, do so. That is if you are OHO. If not, then it's your guess. I wouldn't think you would have to make a trip to the office, though.

FYI: In case you had not heard and were wondering, the federal courts will not be shut down. They have 3 weeks of extra funding generated from filing fees and long term appropriations. Thus, your federal court deadlines still apply unless this lasts longer than 3 weeks....let's hope not.

I hope I am misreading the Congress but this one looks to be an extended shutdown. I agree. Anyone who has ever brokered a three-party negotiation where there are three different preferred outcomes knows how tricky this situation is. Because of the differences between the wants of Dems and Reps in both the House and Senate, as well as those from the WH, I’d argue this is effectively a four to five party negotiation, since I am not sure anyone other than the Dems of the House and Senate agree on what will fix this thing (and I am not sure on that). There is no telling what the end game is.

Tue, Dems saw poll numbers that said 3/4+ of the country were in favor of helping Dreamers, while polls now show that 2/3 of the country are against a shutdown over helping Dreamers.
Me thinks the proper phrasing of the question is important.

At OMHA we’ve been informed that all SALJs and their team members are “excepted” - business as usual unless this goes past the next pay period and folks don’t get paid. Funny how Congress still gets paid even though they’re responsible for the mess.

I don't consider the ire of their constituents to be a real world event, considering how high the advantage is for incumbent candidates . And, gee, November is still a lifetime away in the current instant news world. I don't think the majority of Americans even know about the shutdown yet. Not like most read newspapers, eh? Dont mean to be harsh, but this is total nonsense . We elect you clowns to be capable and faithful public SERVANTS and instead it looks like nursery school, except the 4 year olds have a stronger sense of fairness. For all of you in fed service, my thanks and my prayers are with you. Perhaps someone will bring an actual 4 year old to the Capitol and maybe s/he will figure out a fix. I hope so.

Pixie , you have a subtitle that refers to you as chief cat herder!!!!! lol hey, maybe we should send you to DC and see if you can help "them" strike a deal Since you have experience herding cats, i suspect many of the principles will be the same

The whole thing is a joke. People get furloughed, don't have to work and then get paid when the furlough is over. If they were to announce that everyone furloughed would NOT get paid, the Senators would be flooded with calls telling them to fund the govenment and end this nonsense.
They tell OHO people that all leave is cancelled. So, if you are sick, do you come into work or stay home and get furloughed--and maybe not get paid?

Anything more than three weeks out, I guess there's no need to bother. I have a status conference on Thursday, so will have to email the law clerk, too. All in my four hours on Monday morning. What a hoot.
