It's funny how they sneak this in under the cover of the SCOTUS nomination. This is of concern to a very small portion of the population, this announcement will generate little interest outside a small handful of people (which of course includes everyone reading this). It didn't need cover.

It didn't need cover. It should be a concern to a very large portion of the population. It should get a mention. It is going unnoticed by the traditional press just like the many appointments to the federal bench are happening without a mention. The press is distracted.

So what happens now? Is there going to be notice and comment? Regardless, whenever this is effective, does OHO just post a JOA for open positions? What is the legal status of the open cert at OMHA? Is there a due process issue there for the people on the cert? WTF? I think, first things first, an apology to emby might be in order. Not wanting to stir the pot too much, so this is the last Iāll say about it. But I thought it was worth saying. Questions like these you posted are all good questions ā the very type of thing we could/would want to discuss even before the official announcement of the EO. This is exactly why I think the sharing of intel here should never be discouraged.

I wonder if the people who spent all that time and money testing will purse any redress?Ā As if the union didn't have enough to deal with now comes this new EO.Ā Crazy times afoot... What would we claim? Reasonable reliance? If I pay my own expenses for an interview with a private corporation and they donāt offer me the job, Iām owed nothing. But, gosh, this makes me frustrated.

Yes, about 1% of 1% of 1% of the population impacted = 0% following this process and this new EO.

It seems like no one told potus that each agency doesnāt have to do its own testing and competitive selection - OPM has done that in a standardized manner for all prospective ALJs. There are no āconcerns about undue limitations on the selection of ALJsā each agency does NOT go through a ācomplicated and elaborate examination process or rating procedure.ā And while some here may disagree, portions of the process themselves assess for critical qualities.
This is pure hogwash.
I think every single one of us on this board who has any interest in the ALJ process or system, along with the union and other related organizations should being a massive lobbying campaign to get congress to pass legislation that mandates competitive service as is through OPM, defines our status as āofficersā or whatever including with the APAās removal protections. Iām going to call My congressman and senator today.
The main purpose of this is to allow the POTIS or his designer to remove newly hired ALJs at will.

This is exactly why I think the sharing of intel here should never be discouraged. The fact the intel turned out to be good is irrelevant. It was a reckless thing to disseminate whether true or not. If true, it may have burned a source in the administration. Multiple people might have been suspected of a leak even of not guilty of one. Thanks SSA. The fact of the matter is that the White House is leaking like a sieve and I don't think that the draft that I shared had any special markers in it that would reveal the source. lf1 is not going to change it's mind so whatever.
